YOUR INFORMATION
Athlete Kitchen Privacy Notice
Effective date: September 23, 2026 Version: 2.0
1. Who we are
Athlete Kitchen LLC ("Athlete Kitchen," "we," "us," or "our") runs the Athlete Kitchen waitlist at athletekitchen.fit (the "Waitlist"). This Privacy Notice explains what personal information we collect when you visit the Waitlist site, join the Waitlist, sign in as a member, set preferences, or take part in our referral program, and how we use it.
Contact: support@athletekitchen.fit Mailing address: Athlete Kitchen LLC, 5424 Sunol Blvd, Ste 10-406, Pleasanton, CA 94566, USA
This notice covers the Waitlist only. We are not selling meals yet, and we do not collect payment information on the Waitlist. Before ordering opens, we will publish an updated privacy notice that covers purchases, deliveries and customer accounts.
2. Information we collect
Information you give us
- Email address (required).
- ZIP code (required). We use it to check whether you are within our planned launch area.
- First name (optional), if you choose to give it.
- Optional preferences you set in your member area, such as how many meals per week you are interested in and whether you prefer delivery or pickup.
- Age confirmation: your confirmation that you are 18 or older.
- Email choices: whether you opted in to promotional email, plus the date, time and version of the wording you agreed to.
- Referral code: the code or link you used to join, if someone referred you.
- Messages you send us, such as support, privacy or correction requests sent to support@athletekitchen.fit.
Information created when you use the Waitlist
- The dates and times you signed up, verified your email and gave or changed consent.
- Your Waitlist status, place in line, points, invitations, and referral activity (for example, how many people joined using your link).
- Session information that keeps you signed in to your member area after you open a link we email you. You don't use a password.
Information collected automatically
- Technical data. When you visit the site or submit a form, our hosting and security providers receive your IP address, browser and device type, and basic request details (such as the page requested and the time). This is needed to deliver the site, keep it secure, and prevent spam and abuse.
- Bot protection. When you submit a form, Cloudflare Turnstile checks that you are a person and not an automated program. To do this, it processes technical signals from your browser and device.
Information we do not collect on the Waitlist. We do not ask for payment details, phone numbers, health information, allergy or dietary information, or government ID. Please do not send us that kind of information.
3. Cookies and similar technologies
We use cookies and similar technologies only to run and secure the Waitlist. These include:
- Session cookie. An Athlete Kitchen cookie that keeps you signed in to your member area after you open a link we email you.
- Referral cookie. If you arrive through a friend's referral link, a cookie remembers the referral code for up to 30 days so it can be applied when you join.
- Security technologies. Cloudflare Turnstile uses these to detect bots when you submit a form.
We do not use advertising cookies, tracking pixels, social-media plugins, or third-party analytics tools that track you. Our hosting provider may give us combined measurements of site traffic and performance that don't identify you.
Emails. Our email provider records delivery information, such as whether a message was delivered or bounced. If open or click measurement is enabled, it may also record whether an email was opened or a link was clicked. We use this information only to run and improve our emails, never for advertising.
Because we do not track you across websites or use advertising tools, we do not need to change our practices when a browser sends a "Do Not Track" or Global Privacy Control signal. We will treat such signals as a request not to sell or share your information, which we never do anyway.
4. How we use your information
We use your information to:
- Run the Waitlist. This includes verifying your email address, giving you member access, saving your preferences, checking your ZIP against our planned service area, and managing your place in line, points and invitations.
- Send service emails about your membership, as described in Section 9.
- Send promotional emails, only if you opted in. We send no more than two promotional emails a week.
- Run the referral program. This includes tracking referrals, awarding points, determining eligibility for referral credit, and preventing fraud and abuse.
- Plan our launch. We use combined counts that do not identify you, for example how many members are in each ZIP code or prefer delivery.
- Keep the Waitlist secure. This includes preventing spam, bots, duplicate entries and misuse.
- Respond to you and meet our legal obligations. This includes answering requests and enforcing our terms.
We do not use your information to make decisions about you by automated means that have legal or similarly significant effects. Invitation order is calculated by the published rules in our Waitlist Terms.
5. How we share your information
We do not sell or rent your personal information. We do not share it with partners or other companies for their own marketing. We do not upload your contact information to advertising or social-media platforms.
We share personal information only with service providers that run the Waitlist for us and process it on our behalf. These are website hosting, database storage, email delivery, bot and spam protection, and business email hosting.
We may also disclose information in these cases:
- Legal requirements. When the law, a court order or a valid government request requires it.
- Protection. When needed to protect the rights, safety or property of Athlete Kitchen, our members or others, including to investigate fraud.
- Business transfer. If Athlete Kitchen is involved in a merger, acquisition or sale of assets. In that case, your information would stay subject to this notice or one that is at least as protective.
California "Shine the Light." We have not disclosed personal information to third parties for their direct-marketing purposes, and we do not do so.
6. How long we keep your information
We keep personal information only as long as we need it for the purposes in this notice.
| Information | How long we keep it |
|---|---|
| Unverified signups | Only for a short period. An unverified signup has no place in line, and we delete it if the email address is never verified. |
| Waitlist entry (email, ZIP, first name if given, preferences, consent record, place in line, points and referral activity) | While the Waitlist and our launch are active and you remain a member. We delete it when it is no longer needed for those purposes, or sooner if you ask. |
| Members who become customers | When you become a paying customer, your Waitlist entry has served its purpose and is removed. Your customer account is then covered by the privacy notice we publish for ordering. We keep only what is needed to issue or settle referral rewards under our Referral Program Terms. |
| Technical logs held by our hosting and security providers | For limited periods under those providers' own retention settings. |
| Support and privacy emails | As long as needed to handle your request and keep a record that we did. |
| Do-not-email records | If you unsubscribe or ask us to delete your information, we keep a coded (hashed) version of your email address, the reason, and the date and reference of the request. We keep it as long as needed to honor your choice, and use it only to make sure we don't email you again. |
| Backups | Deleted information may remain in backups kept by our providers for a limited period until they are overwritten. |
We will update this notice with specific retention periods as our processes are finalized. We may keep information longer if the law requires it, or to resolve a dispute or investigate fraud.
7. How we protect your information
We use reasonable administrative and technical safeguards suited to the information we hold. For example:
- We limit who can access it.
- We restrict what the public signup form can do.
- We use emailed, time-limited links instead of passwords.
- We use bot protection on our forms.
No system is completely secure, so we cannot guarantee security. Please keep your email account secure and do not forward your sign-in links to anyone.
8. Your choices and rights
You can ask us to:
- Access. Tell you what personal information we hold about you and give you a copy.
- Correct. Fix information that is inaccurate.
- Delete. Delete your information and remove you from the Waitlist.
- Stop promotional email. You can do this at any time with the unsubscribe link in any promotional email, from your preferences page, or by contacting us.
How to make a request. Email support@athletekitchen.fit from the email address you used to join. To protect your information, we may ask you to confirm the request from that address before we act on it. An authorized agent may make a request for you if they provide your signed permission and you confirm the request from your email address.
When we will respond. We will respond within 30 days. If we need more time, we will tell you why, and we will not take longer than 45 days in total.
What deletion means. Deleting your information removes you from the Waitlist and ends your place in line, your points, and any held or unused referral credit, as explained in our Referral Program Terms.
No discrimination. We will not treat you differently for making a request.
These choices are available to every Waitlist member, wherever you live.
9. Emails we send
Service emails are about your membership. They include:
- email verification and sign-in links
- confirmation that you joined
- Waitlist status and your place in line
- invitations to order when your turn comes
- referral status and credit notices
- important changes to our terms or this notice
You will receive service emails while you are on the Waitlist. To stop them, leave the Waitlist.
Promotional emails (news, menus, offers) go only to members who opted in, and never more than two a week. Every promotional email includes an unsubscribe link. Unsubscribing from promotional email does not remove you from the Waitlist.
Text messages. We do not send text messages from the Waitlist, and we do not collect phone numbers.
10. Age requirement
The Waitlist is only for adults 18 and older. We do not knowingly collect personal information from anyone under 18. If we learn that we have, we will delete it. If you believe a minor has joined, contact support@athletekitchen.fit.
11. Where your information is stored
We operate in the United States, and our service is planned for addresses within 22 driving miles of our production location in the California Tri-Valley. Our database and website are hosted in the United States. Some of our service providers may process certain information, such as logs, backups or support access, in other locations under their own safeguards.
12. Changes to this notice
We may update this notice. We will post the new version on this page with a new effective date. If a change is material, we will email Waitlist members at least 7 days before it takes effect.

When you order, we use your contact details, reviewed delivery address, meal plan, payment references and order status to process your purchase, check delivery eligibility, arrange delivery and respond to order questions. Your phone number helps us contact you about delivery exceptions.
Stripe hosts payment collection. We receive payment and order references and status information, rather than your full card number. Our hosting, database and transactional email providers help operate the website and send order-related communications. An order does not by itself subscribe you to marketing or SMS messages.
