Athlete Kitchen Waitlist Terms
Effective date: September 23, 2026 Version: 2.0
1. About these terms
These Waitlist Terms ("Terms") apply to the Athlete Kitchen waitlist at athletekitchen.fit (the "Waitlist"). Athlete Kitchen LLC ("Athlete Kitchen," "we," "us") runs the Waitlist. Our mailing address is 5424 Sunol Blvd, Ste 10-406, Pleasanton, CA 94566, USA.
When you join the Waitlist, you agree to these Terms. Our Privacy Notice explains how we handle your information. If you share or use a referral link, our Referral Program Terms also apply.
2. What the Waitlist is
The Waitlist is a free list of people who want to hear when Athlete Kitchen opens and be invited to order. We are targeting October 20, 2026 to open ordering. That date may change, and we will tell members by email if it does.
3. Who can join
- Age. You must be at least 18 years old.
- Your own email. You must use your own email address.
- One entry per person. Each person may hold only one entry.
- Individuals only. Each entry is for one individual. Businesses, groups, or entries made on someone else's behalf are not allowed.
4. Joining is free
Joining costs nothing, and you don't need to buy anything. We never ask for payment information on the Waitlist.
5. Verification and member access
- Verification. Your entry becomes active only after you verify your email address using the link we send you. Verification links expire after 24 hours and can be used once. Unverified signups have no place in line and are deleted after a short period. You can join again later.
- Sign-in. Once you're verified, you access your member area through links we email to you. You don't use a password.
- Keep your links private. These links are personal and expire after a limited time. Don't forward them. Tell us right away at support@athletekitchen.fit if you think someone else has accessed your member area.
6. Service area
- Planned launch area. We plan to deliver to addresses within 22 driving miles of our production location in the California Tri-Valley. That includes Pleasanton, Dublin, Livermore, San Ramon, Danville and nearby communities.
- Delivery zones. The launch area has three zones, based on driving distance from our production location:
| Zone | Driving distance | Delivery fee |
|---|---|---|
| Zone A | Up to 6 miles | Free |
| Zone B | 6 to 14 miles | Fee shown at checkout before you pay |
| Zone C | 14 to 22 miles | Fee shown at checkout before you pay (higher than Zone B) |
- Beyond 22 miles. Addresses more than 22 driving miles away are outside the launch area. We don't offer standard delivery there.
- What the ZIP check tells you. It tells you whether your ZIP code is within our planned launch area. Some ZIP codes are partly inside and partly outside the 22-mile limit. Your exact address, zone and fee are confirmed at checkout. The ZIP check is not a promise that we will deliver to your address, offer pickup near you, or charge any particular delivery fee.
- When details are set. Delivery areas, fees and pickup options will be confirmed when ordering opens and may change later.
- Outside the area. If your ZIP is outside the planned launch area, you can still join and receive updates. You won't receive an invitation to order until we serve your area.
7. No guarantee
Joining the Waitlist does not guarantee:
- an invitation to order, or an invitation by any particular date;
- a meal plan, delivery slot, pickup option or particular menu;
- a founding-member spot or any price.
Our kitchen capacity is limited. We may not be able to invite everyone on the Waitlist.
8. Your place in line and invitations
8.1 Who can receive an invitation
You can receive an invitation when all of these are true:
- your email address is verified;
- your ZIP code is within the area we are serving at the time;
- you have not been removed under Section 11.
8.2 Invitation rounds
We send invitations in rounds whenever we have capacity for new customers. There is no fixed schedule. We decide how many invitations each round has, based on how much capacity we have.
8.3 How invitations are ordered
Invitations are shared between two groups, measured across all invitations we send, not within each round:
- 30% chronological. At least 30% of all invitations go to eligible members in the order they joined and verified, earliest first.
- 70% by points. The rest go to eligible members with the most points. Ties are broken by the earliest verification time.
- Uneven rounds. Because the split is cumulative, a single small round may not be exactly 30/70. We balance the split across rounds.
- No double invitations. A member who receives an invitation in one group is not counted again in the other.
8.4 Points
Points are earned only as described in the Referral Program Terms. Points:
- only affect your place in line for invitations;
- have no cash value;
- are not account credit and can't be redeemed for anything;
- can't be transferred or sold;
- never become a discount, a price or a founding-member spot.
8.5 Accepting an invitation
An invitation is personal and can't be transferred. It stays open for 72 hours from when we send it. To accept, complete your order through the link in the invitation email before it expires.
8.6 If an invitation expires
If you don't use your invitation in time:
- you stay on the Waitlist;
- you keep your original verification time and your points;
- you can be invited again in a later round.
If two invitations in a row expire unused, we will pause further invitations to you. You can ask us to start them again at any time by emailing support@athletekitchen.fit.
8.7 Your place can change
Your place in line can change as other members verify, earn points, accept invitations or leave. We may show you an estimated place in line. It is only an estimate, not a commitment.
9. Founding-member program
- Who qualifies. When ordering opens, the first 100 customers whose first weekly subscription payment succeeds, for Training Fuel 10 or Performance System 15, become founding members. The order is set by when that payment succeeds at checkout.
- What doesn't count. First Fuel Week and Race Week Fuel purchases don't count toward a spot on their own.
- Refunds and reversals. If the first subscription payment is fully refunded or reversed, the spot is released.
- Founding pricing. Founding members receive a price
lock for the first 8 weeks of their weekly subscription:
- Training Fuel 10 at $155 per week (standard price $169 per week);
- Performance System 15 at $245 per week (standard price $269 per week).
- After week 8. Standard pricing applies automatically from week 9. Weeks that are paused or skipped still count toward the 8 weeks. The full billing terms will appear at checkout.
- What doesn't give you a spot. Your place on the Waitlist, email verification, points, referrals and invitations do not give you a founding-member spot or founding pricing. Founding spots may run out before you are invited.
10. Emails
While you are a member, we send service emails about your membership. Examples: verification, sign-in links, status, invitations, referral notices and changes to these Terms. Promotional emails are optional. You only receive them if you opt in, and never more than two a week. Our Privacy Notice has the details.
11. Fair use and removal
You must not:
- create fake, duplicate or disposable-email entries, or entries for other people without their permission;
- use bots, scripts or other automated means to sign up or earn points;
- try to manipulate your place in line, points or invitations, or interfere with the Waitlist or its security.
If we reasonably believe you have broken these Terms, we may remove your entry, points or invitations. We will tell you by email, and you can reply to ask us to review the decision.
12. Optional member extras
From time to time, we may offer optional extras such as menu polls, surveys, or badges shown in your member area. These extras:
- are for fun and feedback only;
- have no monetary value;
- don't affect your place in line or your eligibility for anything;
- don't commit us to any menu or product.
We may change or end them at any time.
13. Leaving the Waitlist
You can leave at any time. To do so, email support@athletekitchen.fit from the address you joined with, or use the option in your member area if one is available. We also remove entries according to our Privacy Notice.
We may end the Waitlist at any time. If we do, we will tell members by email.
14. Changes to these Terms
We may update these Terms. We will post the new version on this page with a new effective date. If a change is material, we will email members at least 7 days before it takes effect. If you don't agree with a change, you can leave the Waitlist. Changes do not apply retroactively to invitations already sent.
15. Disclaimers
- Provided as is. The Waitlist is a free service provided "as is" and "as available."
- What we don't promise. To the extent the law allows, we make no promises about the Waitlist beyond those stated in these Terms.
- Outside the Waitlist. Nothing on the Waitlist is an offer to sell food. Purchases will be governed by the terms of sale shown at checkout.
16. Limitation of liability
To the extent the law allows, Athlete Kitchen is not liable for any indirect, incidental, special or consequential damages arising from the Waitlist. Our total liability for any claim relating to the Waitlist is limited to $100. Nothing in these Terms limits any liability that cannot be limited under applicable law.
17. Governing law and disputes
- Governing law. These Terms are governed by the laws of the State of California, not counting its conflict-of-law rules.
- Talk to us first. Please contact us first at support@athletekitchen.fit so we can try to resolve any problem informally.
- Where disputes are heard. Any dispute that isn't resolved informally will be heard in the state or federal courts located in Alameda County, California, unless it qualifies for small claims court.
